Business Gift Deduction: The $25 Per Person Limit and How to Maximize It
The business gift deduction under IRC 274(b) is one of the most restrictive provisions in the tax code. The deduction is capped at $25 per recipient per year, a limit that hasn’t changed since it was enacted in 1962. Even a $500 gift to your best client produces only a $25 deduction. The key to maximizing the tax benefit is understanding what does and doesn’t count as a “gift” under the rules. Items under $4 with the business name printed on them are classified as advertising expenses (fully deductible with no dollar cap). Awards to employees for length of service or safety achievements have separate, higher limits. And the distinction between a gift and entertainment matters: a gift that’s also entertainment (concert tickets you give to a client to attend without you) is subject to the $25 gift limit, while entertainment you attend together is subject to the entertainment rules (0% deductible after the TCJA). Choosing the right classification can mean the difference between a $25 deduction and a $0 deduction.
