Employment Tax Deposits: 941 Filing Schedule, Deposit Deadlines, and Penalty Avoidance
Federal employment taxes (federal income tax withholding, the employee share of Social Security and Medicare, and the employer share of Social Security and Medicare) must be deposited with the IRS on a strict schedule. The deposit schedule is determined by looking back at the total tax liability reported on Form 941 during a four-quarter lookback period (July 1 through June 30 of the prior fiscal year). Employers with $50,000 or less in lookback period liability are monthly depositors; those with more than $50,000 are semi-weekly depositors. All deposits must be made electronically through the Electronic Federal Tax Payment System (EFTPS) or through a payroll provider. Form 941 (Employer’s Quarterly Federal Tax Return) is filed quarterly to report wages, tips, withholding, and reconcile deposits against liability. Late deposit penalties escalate quickly, from 2% for deposits 1-5 days late to 15% for amounts still unpaid 10 days after an IRS notice, making payroll tax compliance one of the most penalty-heavy areas of tax law.
Deposit schedule determination:
| Lookback Period Liability | Schedule | Deposit Due |
|---|---|---|
| $50,000 or less | Monthly | 15th of the following month |
| More than $50,000 | Semi-weekly | Within 3 business days of payday |
| New employer (first year) | Monthly (default) | 15th of the following month |
| $100,000+ accumulated in any period | Next business day | Next business day (regardless of schedule) |
| $2,500 or less per quarter | With Form 941 | Quarterly filing deadline |
Semi-weekly deposit rules:
| Payday Falls On | Deposit Due By |
|---|---|
| Wednesday, Thursday, or Friday | Following Wednesday |
| Saturday, Sunday, Monday, or Tuesday | Following Friday |
Late deposit penalties (IRC 6656):
| Days Late | Penalty Rate |
|---|---|
| 1-5 days | 2% |
| 6-15 days | 5% |
| 16+ days | 10% |
| 10+ days after first IRS notice | 15% |
Form 941 quarterly deadlines:
| Quarter | Period Covered | Filing Deadline |
|---|---|---|
| Q1 | January 1 - March 31 | April 30 |
| Q2 | April 1 - June 30 | July 31 |
| Q3 | July 1 - September 30 | October 31 |
| Q4 | October 1 - December 31 | January 31 |
If the deadline falls on a weekend or holiday, the deadline moves to the next business day. If all taxes for the quarter were deposited on time, you get an additional 10 days to file Form 941.
How do deposit schedules work in practice?
What payroll tax obligations does an employer have?
Employers must withhold federal income tax, Social Security tax (6.2%), and Medicare tax (1.45%) from employee wages, then match the Social Security and Medicare portions from their own funds. The employer’s total payroll tax cost is at least 7.65% of wages on top of what the employee pays. Federal unemployment tax (FUTA) adds 6% on the first $7,000 of each employee’s wages, reduced to 0.6% in states with approved unemployment programs (most states). Payroll taxes must be deposited on a semi-weekly or monthly schedule depending on your total tax liability, and late deposits trigger escalating penalties (2% to 15%). Officers and other “responsible persons” who willfully fail to collect and remit payroll taxes face the trust fund recovery penalty (IRC 6672), which is 100% of the unpaid trust fund taxes and is assessed personally.
