Innocent Spouse Relief: How to Remove Tax Liability from a Joint Return

Written by Yarik Yarosh, CPA (US & Canada) September 5, 2026 · FL CPA license AC61704 · CPA Ontario

When married taxpayers file a joint return, both spouses are jointly and severally liable for the entire tax liability on that return. This means the IRS can collect the full amount from either spouse, regardless of who earned the income or who made the error. For spouses who were unaware of their partner’s unreported income, inflated deductions, or fraudulent positions, this creates an enormous financial exposure. IRC 6015 provides three types of relief.

✓Key takeaway

Innocent spouse relief options (IRC 6015):

1. Innocent spouse relief (IRC 6015(b)):

  • Requirements: (a) there is an understatement of tax attributable to erroneous items of the other spouse, (b) the requesting spouse did not know and had no reason to know of the understatement at the time they signed the return, and (c) it would be inequitable to hold the requesting spouse liable.
  • Relief: the requesting spouse is relieved of liability for the understatement, including tax, interest, and penalties attributable to the other spouse’s erroneous items.
  • Deadline: must be filed within 2 years of the date the IRS first began collection activity (Notice CP504 or the first levy action).

2. Separation of liability (IRC 6015(c)):

  • Requirements: the requesting spouse is no longer married to (or is legally separated from) the other spouse, OR has not been a member of the same household as the other spouse during the 12 months prior to the request.
  • How it works: the understatement is allocated between the two spouses as if they had filed separate returns. Each spouse is liable only for their allocated portion.
  • Limitation: relief is not available if the requesting spouse had actual knowledge of the erroneous item (burden of proof on the IRS).

3. Equitable relief (IRC 6015(f)):

  • This is the catch-all provision. Available when the requesting spouse does not qualify for relief under (b) or (c) but it would be inequitable to hold them liable.
  • Available for both understatements (unreported income) AND underpayments (the return was correct but the tax was not paid).
  • The IRS considers factors including: marital status, economic hardship, knowledge or reason to know, legal obligation (divorce decree assigns liability to the other spouse), significant benefit (did the requesting spouse benefit from the understatement?), compliance history, and mental or physical health.
  • Rev. Proc. 2013-34 provides a streamlined determination for certain cases.

Filing for relief:

  • Form 8857 (Request for Innocent Spouse Relief)
  • The IRS notifies the other spouse and allows them to participate in the determination
  • If denied, the requesting spouse can petition the Tax Court within 90 days
