Section 179D: Energy-Efficient Commercial Building Deduction for Building Owners and Designers
The Section 179D deduction turns energy-efficient construction and renovation into an immediate tax benefit. Under IRC 179D, commercial building owners can claim a deduction (not a credit) for installing energy-efficient lighting, HVAC, or building envelope systems that meet specific energy reduction standards. The Inflation Reduction Act of 2022 transformed this provision from a rarely-used niche deduction into a significant incentive by making it permanent, increasing the maximum deduction to $5.00 per square foot (with prevailing wage and apprenticeship compliance), and allowing it to be reclaimed every three years for subsequent improvements. The deduction applies to any building that is not a residential rental property (apartments, single-family rentals), which means it covers office buildings, retail spaces, warehouses, restaurants, medical offices, hotels, and mixed-use buildings (for the commercial portion). For architects and engineers who design energy-efficient systems for government buildings (federal, state, or local), the deduction is allocable to the designer because the government entity has no tax liability. This makes Section 179D one of the few provisions where a service provider can claim a deduction for work done on a client’s building.
Section 179D deduction rates (post-IRA, effective 2023+):
