Tax-Loss Harvesting for Business Owners: How to Turn Investment Losses Into Tax Savings

Written by Yarik Yarosh, CPA (US & Canada) September 5, 2026 · FL CPA license AC61704 · CPA Ontario

Every realized investment loss is a potential tax asset. Under IRC 1211, capital losses first offset capital gains dollar-for-dollar (short-term losses offset short-term gains first, then long-term gains, and vice versa), and any remaining net capital loss can offset up to $3,000 of ordinary income per year. For a business owner in the 37% bracket, the $3,000 deduction saves $1,110 per year, which over a decade of carryforward can offset $33,000 in gains. But the real power of tax-loss harvesting isn’t the $3,000 annual ordinary income offset; it’s the ability to time the realization of losses to offset specific capital gains events. A business owner who sells a property for a $500,000 capital gain can harvest $500,000 of paper losses in the investment portfolio the same year, reducing the capital gains tax to zero. The investment portfolio’s composition does not change (the harvested positions are replaced with similar, non-identical investments), but the tax bill is reduced by $119,000 (23.8% of $500,000). The wash sale rule (IRC 1091) is the primary constraint: if the taxpayer buys “substantially identical” securities within the 61-day wash sale window, the loss is disallowed and added to the basis of the replacement shares.
