The rules for deducting business meals have changed multiple times in recent years, and 2025 brings a simpler (but less generous) landscape. The standard rule under IRC 274(k) is that business meals are 50% deductible when the taxpayer or an employee is present and the meal is not lavish or extravagant. The temporary 100% deduction for food and beverages from restaurants (enacted under the Consolidated Appropriations Act of 2021) applied only to 2021 and 2022 and has expired. Meals provided on the employer’s premises for the convenience of the employer, which were historically 100% deductible, have been at 50% since 2018 under IRC 274(n)(2)(B), and that provision was not changed by the OBBBA. The one category that remains 100% deductible is food and beverages provided at company-wide recreational events (holiday parties, summer picnics, team outings) that are open to all employees, treated as a de minimis fringe benefit under IRC 132(e).
