Work Opportunity Tax Credit (WOTC) for Small Businesses
The Work Opportunity Tax Credit (WOTC) under IRC 51 is a dollar-for-dollar tax credit available to employers who hire individuals from specific targeted groups. The credit ranges from $2,400 to $9,600 per qualified employee, depending on the target group and the number of hours worked. Despite being one of the more generous hiring credits, many small businesses do not claim it because they are unaware of the program or miss the 28-day certification deadline.
WOTC eligible target groups and credit amounts:
-
Veterans. Credit: $2,400-$9,600 depending on disability status and length of unemployment. A veteran unemployed for 4+ weeks: $2,400. A veteran unemployed for 6+ months: $5,600. A disabled veteran unemployed for 6+ months: $9,600.
-
SNAP (food stamp) recipients. Ages 18-39. Credit: $2,400 (if the employee works 400+ hours).
-
TANF (welfare) recipients. Credit: $2,400 for short-term recipients; $9,000 over 2 years for long-term recipients (received TANF for 18+ months).
-
Ex-felons. Hired within 1 year of conviction or release from prison. Credit: $2,400.
-
Supplemental Security Income (SSI) recipients. Credit: $2,400.
-
Summer youth employees. Ages 16-17, living in empowerment zones, working between May 1 and September 15. Credit: $1,200 (lower maximum first-year wages of $3,000).
-
Vocational rehabilitation referrals. Credit: $2,400.
-
Long-term unemployment recipients. Unemployed for 27+ consecutive weeks and received unemployment compensation. Credit: $2,400.
-
Designated community residents. Ages 18-39, living in empowerment zones. Credit: $2,400.
-
Qualified long-term family assistance recipients. Credit: $2,400 first year, additional credit second year (total up to $9,000 over 2 years).
Certification process:
- The employer must submit IRS Form 8850 (Pre-Screening Notice and Certification Request), along with DOL Form 9061 (Individual Characteristics Form), to the State Workforce Agency (SWA) within 28 days of the employee’s start date
- The SWA verifies the employee’s eligibility and issues a certification
- Without the certification, the credit cannot be claimed
- The 28-day deadline is absolute: if Form 8850 is not submitted within 28 days, the credit is lost for that employee
Credit calculation:
- First-year wages: 40% of the first $6,000 in wages for employees who work 400+ hours = $2,400
- For employees who work 120-399 hours: 25% of the first $6,000 = $1,500
- For employees who work fewer than 120 hours: no credit
- Higher maximums apply for certain groups (long-term TANF recipients, disabled veterans)
Claiming the credit:
- Form 5884 (Work Opportunity Credit)
- The credit is a component of the general business credit (Form 3800)
- The credit reduces income tax dollar-for-dollar
- Unused credits carry back 1 year and forward 20 years

How does the small business health care tax credit work?
The small business health care tax credit under IRC 45R provides up to 50% of employer-paid premiums (35% for tax-exempt employers) for businesses that cover at least 50% of employee-only premium costs. To qualify, you must have fewer than 25 full-time equivalent employees with average annual wages below $58,000 (2025, indexed), and you must purchase coverage through the SHOP marketplace. The credit is calculated on a sliding scale, with the maximum credit available only to employers with 10 or fewer FTEs and average wages of $29,000 or less. You can claim this credit for only two consecutive tax years, so timing the credit to coincide with your highest premium costs maximizes its value. The credit is claimed on Form 8941 and reduces your tax liability directly.
